Hi Kelly,

"Ultra Moisturizing" seems to be a cosmetic claim. Lip products that "protect from chapping" or "heal chapping" are drug claims - so don't go there. Of course, moist lips are more attractive, so that's also a cosmetic aspect. The word "balm" seems to lean toward being considered a "drug", so if you have a different term you can use to describe your product that moisturizes and makes lips more attractive, that would probably be a good idea.

You don't need to jump through any hoops at all so long as you stay with a cosmetic product. Get into the realm of drugs and you're in a complete different (and really uncomfortable and expensive) world.

Well, it turns out that we got someone to purchase the business, so ForSoapmakers.com isn't closing after all ... but I will be out of it. I am very excited about having more time for the things in my life that I really want to do!

I don't have any info on it, sorry. I did notice that the forms they had (not sure if they are still using them) were for both cosmetics and pharmacies. I can see a pharmacy needing a big bond and fingerprinting --- but cosmetics?? Try continuing to call the department, but also send a letter or a fax. If that doesn't work, try going to your local state representative to see if you can get some help.

It's my understanding that the Florida regulations only apply to products MANUFACTURED in Florida. If you manufacture elsewhere, you can still sell within Florida as far as I know.

I'm curious what limitations there are for businesses outside of Florida to sell to Florida residents. It's my understanding that we have to have permits too, no?

Hello Marie,
I printed an application for a permit, and on one of the questions it asks:
Have you included evidence of $100,000 bond security required by 499.012 (2) a or c
Does this mean that the cosmetic manufacturers have to post a bond as well as a fingerprint card?
I called Florida DBPR but could not talk to anyone. Do you have any information on this ?
Thanks

Wow Marie, this is the second soap-related business closure I've read about this morning! My inclination is to say I'm so sorry to hear it, but after reading your blog post above, it sounds like the right thing for you to do. It's funny how when we are unfocused, all sorts of things can creep in and take us off track.

I heard the term "accidental entrepreneur" the other day to describe someone who is looking for a job & ends up deciding to start their own business instead (which is what happened with me) and I think a lot of business decisions end up being accidental too.

Good for you that you are deciding what you want your life to be and making decisions to support that. Selfishly I am glad to see the handcrafted soap industry made your list of areas of your life that you want to keep, since you are such a source of knowledge & inspiration for so many others. And I hope teaching (in one form or another) will still be on your list of things you want to continue.

All the best to you always :)

I am very confused about the lip balm regulations and wondered if you could help me? I am a very new company (I don't even have my product entered into my website yet) and I am wanting to sell my fantastic :) lip balm. I have called it "ultra moisturizing." Is that o.k.? Am I supposed to be jumping through major hoops to sell it, such as FDA approval, etc.? Please help!

Thanks!

Dear Marie,
I sent a paint mixer fitted to a drill, for my sister who makes goats milk soap in the Philippines. Unfortunately it melted while mixing the caustic soda (lye) and milk. Is the squirrel mixer you use, a stainless steel one? If so, where can I purchase the item? Hoping for your response.
